Red Hat escalated the legal war over Linux on Monday by announcing that it has filed a lawsuit against the SCO Group. The seven-count suit seeks, among other things, a declaratory judgment that Red Hat has not violated SCO's copyrights or trade secrets, Red Hat CEO Matthew Szulik said at a news conference here Monday. "We have asked the courts to declare that no violation of intellectual property and trade secrets have occurred," Szulik said. "We've been patient, we've listened, but when our customers and the whole open-source community are threatened with innuendo and rumor, it's time to act."

Software maker SCO Group fired back at Linux leader Red Hat on Tuesday and revealed steep licensing prices for Linux users who want to steer clear of the company's legal wrangle with the open-source operating system. In a teleconference with media and financial analysts, SCO CEO Darl McBride bluntly accused Red Hat of distributing Linux software that illegally copies SCO's Unix code. "Red Hat's lawsuit confirms what we've been saying all along--Linux developers are either unable or unwilling to screen the code" that goes into the Linux kernel, McBride said. "Red Hat is selling Linux that contains verbatim and obfuscated code from Unix System 5."

Red Hat is right. SCO has MS's hand up their ass as the puppet master.

Actually, what I find pretty funny is the SCO had a Linux distro themselves. This means even if there was code within the Linux kernel (which there isn't) that was from System 5, SCO relinquished any claim they had by distributing Linux under the GP licence. You can also still download SCO's linux distro from their ftp site :rolleyes:

In a 45-page document that it filed late Wednesday, IBM argues that because SCO distributed a version of Linux under the open-source General Public License (GPL), it can't claim that Linux software is proprietary.

On SCO's site:
the sale of SCO Linux products to new customers is currently suspended due to intellectual property (IP) issues associated with the Linux operating system. Accordingly, SCO has announced the suspension of its own Linux activities until the issues surrounding Linux IP and the attendant risks are better understood and properly resolved

I knew at one time they had a distro.

I do believe that open source will never go away.

Holy hell, IBM will rip SCO apart....look at their stats:

Shares of IBM gained 61 cents to $80.36 in Thursday trading on the New York Stock Exchange. SCO shares fell $1.39, or more than 11 percent, to $10.61 in afternoon trading on the Nasdaq Stock Market.

Yeah, SCO bought Caldera Systems (Caldera Linux).

I like the way Linus has avoided most mud on this... Also, SCO now demand $32 US from Sharp for every Zaurus PDA sold. :) Eat me!

In the 45-page filing in Utah federal court, IBM asserts SCO devised a "campaign of falsehoods" that creates "the false impression that SCO holds the rights to Unix that permit it to control not only all Unix technology but also Linux."

OUCH.

What about OSX.....MAC.........Jaguar or what ever it is called
